Slip & Fall Lawyer Sandpoint, ID

Having successfully completed all stages of litigation—including jury trials—for our clients in slip and fall cases and premise liability cases more generally, and knowing what it takes to swiftly and successfully settle our clients’ slip and fall claims, our attorneys know the importance of gathering all relevant evidence. This includes gathering photographs showing the dangerous condition that caused your injuries; talking to witnesses; acquiring store surveillance videos to show the hazardous condition and how long the business had allowed it to remain prior to your fall; procuring evidence of similar prior incidents; and retaining safety experts and experts to testify about code violations. We will do everything we possibly can to minimize your recovery time and maximize the amount of compensation you can get.

Our Sandpoint, Idaho Slip and Fall Lawyers Have the Experience Needed To Win Your Case and Get You The Compensation You Are Legally Entitled To

Slip and Fall Injuries

The laws of the State of Idaho impose a legal obligation upon businesses and property owners to maintain their premises in a “reasonably safe condition,” to correct hazardous conditions the business or property owner either knew or should have known about, by the use of reasonable care, and warn their patrons of unsafe conditions about which the Defendant had, or should have had, knowledge greater than that of the injured party. When employees or management of a business fail to correct an unsafe condition which they knew or should have known about, or fail to warn their customers of a dangerous condition, slip and falls accidents often occur, causing a potentially serious personal injury. Slip and fall accidents fall under premise liability.

The attorneys at The Sargent Firm have years of experience successfully getting our clients the compensation they are legally entitled to. If necessary, we will take your claim all the way to trial court. We do not let insurance companies and other liable parties bully our clients. Because of our relentless tenacity and commitment to our clients, we have a strong, proven winning streak. We are incredibly proud of our superior track record of holding businesses and their insurance companies accountable for their negligence, getting millions of dollars in compensation for our clients who were harmed by the careless and negligent conduct of businesses and individuals.

What About The State of Idaho’s Comparative Fault Law?

What if the business owner/individual or their insurance company asserts that you were partially at fault for the accident and contributed to your own injuries?  Under current Idaho statutes, the law provides that in a negligent action, such as a slip and fall case, comparative fault indictable to the claimant diminishes proportionately the amount awarded as economic and noneconomic damages for an injury attributable to the claimant’s contributory fault, but the law does not bar recovery.

In layman’s terms, comparative fault means that your financial compensation in a personal injury accident claim can be reduced by the percentage of fault that is assigned to you by the court. Conversely, it also means that even if you were primarily at fault, you can still recover partial compensation for any percentage of fault that can be assigned to the business or individual that caused your slip and fall accident.

For example, a slip and fall accident results in $100,000 in personal injury damages to you. If the Defendant business owner or individual was found by the jury to be 90 percent at fault for the accident and you were found to be 10 percent at fault, you could still get $90,000 in personal injury compensation from the business owner or individual. On the flip side, if the Defendant were found to be 10 percent at fault and you were 90 percent at fault, you could still get $10,000 in personal injury compensation from the property owner or individual.

As you can see, the law can be complicated. That is why it is best to have an expert lawyer on your side to fight for you. The Sargent Firm in Sandpoint, Idaho knows how to win even the most complex of cases. We offer free consultations, so you have nothing to lose to have your case analyzed by experts.
